The FDA (Food and Drug Administration) has never been allowed to regulate cigarettes, despite the fact they contain an addicitive drug, nicotine, and over 4,000 toxic compounds, some of which are radioactive.

Despite decades of efforts by anti-smoking activists, Big Tobacco, through the use of huge amounts of campaign contributions, junkets and gifts to politicians, "smoker's rights groups (acually front organizations for Big Tobacco), and court challenges, have been able to stymie all efforts to bring cigarettes under the control of the FDA. Additionally, pro-big business types, free market proponents, and libertarians have also fought bringing cigarettes under the administration of the FDA.

At present, all it would take would be a single piece of legislation in Congress to allow the FDA to regulate cigarettes.

COMMENTS:
I believe that acting stupid must be a right guaranteed in the Constitution somewhere? At any rate, outlawing cigarettes would be like Prohibition. They should enforce rights for nonsmokers in public indoor areas, though, especially in businesses where employees have to breath whatever's in the air all day every day. And there's nothing wrong with lawsuits against tobacco companies for false information and negligence. I don't know if the FDA would be helpful in those areas or not.
