Psychics know a good scam when they see one (just like all other grifters) and they usually won't play the lottery and waste their money like the suckers who use their "services" might.
Who's to say that some legitimate ones don't? Not all people with psychic ability are famous television con artists that we know the every move of.
And who says that psychics are able to pick winning lottery numbers? Many I've spoken with don't have a choice in regards to the premonitions they get.
