Should this be Grounds for impeachment or an indictment ? Each President recites the following Oath, in accordance with Article II Section I of the United States Contitution: "I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States." It seems to me that to start a war (undeclared) and use that as an excuse/reason to not adhere to the tenets of this Document is/may be unlawful. What's your take on this troublesome issue ? And what should be done to a Governing body that condones these action if they are deemed to be unlawful?

The only problem with your logic soothsayer is that the President can evoke wartime powers that allow him to disreguard the Constitution to a certain extent inorder to preserve the nation.Wilson used wartime powers during WW1 to clamp down on free speech, Lincoln used them to end Habeaus Corpus,FDR to intern suspected enemy agents etc.None of these presidents was every impeached, I doubt Bush can be on these grounds.

Corrupt, one flaw in your statement. At this date, there's been no formal declaration of war by Congress. That's in the Constitution, too.

There hasn't been a declared war since World War 2. We haven't impeached anyone but Clinton and that wasn't related to any war issue. The problem with any of the rushes to impeachment is that while it sounds good an ample case to win I have not seen.

Applerod, as far as the Iraq war is concerned we will know our job is done when the Iraqis' can provide their own security for themselves.When that will be is difficult to determine however I don't argue with Bush that we should stay there indefinately,I say that if by 08 the situation is not better it's time to pull out and split that nation into three parts.

Truthseeker you're correct that there hasn't been a declaration of war issued by the Congress but Congress did authorize the President to take military actions against Iraq, so Bush is following the law.
