COMMENTS:
The reason I excluded the chance of exonnerating the man later is that I believe a person should only face the death penalty when the evidence is overwhelming. War criminals, serial killers, and the like. For instance, there is no doubt of saddams guilt, we can execute him with a clear conscience.

I'd say both are the same, so this argument cannot be used against capital punishment.

^I am against the death penalty simply because the act of killing the perpetrator is basically letting the society sink down to their level - has nothing whatsoever to do with how guilty they are or how much they deserved it. so to your question, sending them to prison would be better because we do not corrupt the general public by a state sanctioned murder.

Ultimately, the death penalty would be the worst form of punishment. The wilfull taking of another human life cannot IMO be justified.

Don't underestimate the small things in existence. Simple experiences that people everyday take for granted. Just being able to sit and think, the types and patterns of things, sensing and experiencing, rememebering and reflecting, letting your imagination soar, dreaming, eating even the most simple meal- so many things- getting to get visits from your loved ones. But that's just me. Every single moment of my existence- even the most smallest things- I try to appreciate. Never take anything for granted. Not even the little things. Realising it when exhaling your last breath is too late, know this now- appreciate existence- including the small everyday experiences.

I believe that the death penalty is wrong no matter what carefully constructed hypothetical situation herzog chooses to conjure up.

If he were put to death for a crime he didn't commit, History forever records him as a murderer. Chances of him being exhonorated are nil, since no one will pursue proving his innocence (What would be the point once the sentence is carried out)? On the other hand, If he lives out his time, he and others, can still pursue exhonorating him, no matter what the out come, He still has the chance until the fateful day of his death. Though, both are horrific for an innocent man. If it were me, I'd want a chance to be exhonorated.
