DO YOU AGREE WITH REMOVING THE STATUTE OF LIMITATIONS FROM RAPE CASES?

[+] serious ballot by jappy

There is a push by many states these days to change the laws by removing the statute of limitations on rape cases. Currently only homicides have no statute of limitation on prosecution for the crime.

Advocates for this change say it gives law enforcement a chance to charge sex offenders to the full extent of the law once they are captured, for all the sexual assaults they have committed. They also believe that, short of murder, sexual assaults are the most horrific crimes that can be perpetrated, therefore should have extra time to prosecute to allow the victims closure.

Opponents say that this would be unfair to those accused of such crimes because it gives any person the power to effectively destroy a person's reputation at any time for a crime they did not commit. Those against this change believe also that the relatively recent controversial surge in 'lost memory recovery', which has been shown to be inaccurate in many cases, could ruin many innocent people's lives.

What are your thoughts, should the statute of limitations be removed from sexual assault crimes?

The statute of limitations should be removed
The statute of limitations should be left as it is.
The statute of limitations should be changed, but not removed.

COMMENTS:
I find sexual assaults to be the ultimate in henious crimes, that being said however, I believe removing the statute of limitations from such crimes creates an unreasonable situation for the accused because there is never any freedom for someone who is wrongly charged with such a crime.

Also, murder rates this because you can never bring someone back once they have been killed. To move on after a sexual assault is a difficult process, but there is no moving on after you have been murdered.

I think that most people are aware enough of some bad therapists encouraging "lost" memories by now. Any crime should be punished only if there's solid proof of the crime. But a crime with severe long lasting effects shouldn't be forgotten about.

There is no statute of limitations on rape cases.
Not if you rape someone I care about!
Someone does that and they will wish they could escape the kind of personal payback they have coming by being locked away safely in prison.
You have my word on that!

jappy, I don't think there ever *should* be any freedom for anyone who commits such a crime. Being raped is the Ultimate Theft. What's taken from you can *never* be retrieved, by any means.

I agree with you Truthseeker, but I also know that there are people out there who would use this change as a vendetta against someone who never did the crime, I've seen it first hand how crying rape can get someone in a world of hurt for nothing.

Inmo rape is just as terrible a crime as murder. A rapist takes away a persons mental freedom for the rest of their life.

I don't think that people understand that it gives the prosecution a very strong upper hand. While DNA evidence is amazing, it only proves that there was sexual intercourse. It does not state whether it is consensual or not, and in that case, you could potentially convict an innocent man. If the only evidence is DNA, then what evidence can the defense find after 20 years to combat the allegation?
