Flag burning is an ironic act.
Banning the desecration of the American flag would only increase the number of flags getting burned, as the act would change from being a display of bad manners to an act of civil disobedience. Also, since most flag burnings take place outside the U.S., how are you going to stop that? Declare them enemy combatants and transport (i.e. kidnap) them and take them to Gitmo? Also, it would lead to those idiotic court cases, where some poor schmuck would be hauled before a judge because he had a flag patch sewn onto his poodle's little winter jacket.

Yes, it should be considered freedom of expression, but the individual burning the flag should realize: 1. Someone bigger and badder than him may decide to exercize his freedom of expression on the flag burners head. 2. If you burn anything in public, especially of that size, you are committing a crime (check your city's municipal code) and endangering the public. I don't have a problem with someone portraying the American Flag in a bad light as legitamite artistic expression in an art gallery, but flag burning in public is another story.

I've said this before- if someone decides that they want to burn Old Glory, then they should have to sit down and watch film of someone burning the flag of a foreign country where such is illegal, along with the resultant execution. Just a way to let them know that the freedom they enjoy isn't a universal thing.
