Deployed Troops Battle for Child Custody

She had raised her daughter for six years following the divorce, handled the shuttling to soccer practice and cheerleading, made sure schoolwork was done. Hardly a day went by when the two weren't together. Then Lt. Eva Crouch was mobilized with the Kentucky National Guard, and Sara went to stay with Dad.

A year and a half later, her assignment up, Crouch pulled into her driveway with one thing in mind _ bringing home the little girl who shared her smile and blue eyes. She dialed her ex and said she'd be there the next day to pick Sara up, but his response sent her reeling.

"Not without a court order you won't."

Within a month, a judge would decide that Sara should stay with her dad. It was, he said, in "the best interests of the child."

What happened? Crouch was the legal residential caretaker; this was only supposed to be temporary. What had changed? She wasn't a drug addict, or an alcoholic, or an abusive mother.

Her only misstep, it seems, was answering the call to serve her country.

Crouch and an unknown number of others among the 140,000-plus single parents in uniform fight a war on two fronts: For the nation they are sworn to defend, and for the children they are losing because of that duty.

A federal law called the Servicemembers Civil Relief Act is meant to protect them by staying civil court actions and administrative proceedings during military activation. They can't be evicted. Creditors can't seize their property. Civilian health benefits, if suspended during deployment, must be reinstated.

And yet service members' children can be _ and are being _ taken from them after they are deployed.

I think the father was pissed off because the mother did something that exluded him. It made him less of a man. He was punishing her because she took on what he considered a male's role. How many mothers do you know would consider their child abandoned if the husband voltuneered for military service? They would be ecstatic they came back alive! It sounds like he premeditated the whole thing. I think the judge must have been a sadistic women-hater. The husband knew where she was and he knew how to reach her. Why wasn't she notified? There must be something she can do. It seems what the judge did was about as illegal as you can get. The judge condoned kidnapping!

The good news is she has 2 parents that love her and want to be in her life. The bad news is the fighting isn't helping her or anyone else. Court should be a last resort. It's sad that they felt they had to take that route.
The court decided that the child would be best served by staying with her father. The story glazed over the reason the court came to this decision, because it is biased and more concerned with manipulating the public than informing them.

Considering the disgracefully bias against custody by fathers within the judicial system, I find iut hard to feel partiocularly sorry for this one woman.

Once again, your mpriorities are skewed.

Why dont you make a ballot about one of the many fathers who have lost their children simply because they have a penis? That way you can bring attention to the real problem, not some rare, isolated incident, completely contrary to the norm.

If the child was deemed better off with the mother before the mother's deployment to Iraq, then it is hard to understand how the court could unilaterally change the custody situation based solely upon the mother's service to her country.

The mother should not lose custody, decisions like these made by the courts demonstrates the level of stupidity by many judges...

BTW, KATG, get a grip, the ballot is regarding a mother losing custody of her daughter while servicing her country (in a war based on a LIE), try impressing all of us and do what this woman has already done (serving her country), I'm putting my money on your spineless arse that you will not do the same...

It kinda sounds like you're saying her patriotic service to her country should give her some sort of favour. It doesn't, and shouldn't.

The thing you're overlooking, is a year and a half is a long time in a child's life.

A court will normally choose the option which disrupts the children the least, while they await a proper custody hearing. That's when it'll be decided what's in the child's best interests.

She's just found out what people with a penis usually have to go through.

This woman is being treated unjustly. I don't think that the unjust treatment received by others makes her suffering any less legitimate.

That certainly does happen. However, I'm not the only person on B&W who can make ballots. If this is an important issue for you, why don't you make a ballot about it?

I don't think that anything qualifies as "the problem." There are a lot of problems in the world, and the existence of one doesn't preclude the legitimacy of another. And it is, apparently, becoming less rare all the time.

Of course not. It just seems slightly suspect that you decide to talk about the mouse peeking out from under the cabinet, rather than the 600 pound, shit covered elephant standing in the middle of the room.

I think its because, following the doctrine that the rights of the minority supersede the rights of the majority as you clearly do, you subconciously have more sympathy for this woman than you do for the thousands of men suffering the same pain. You feel this way because you have been taught that all minorities are given a bad rap by the system, and need your protection.

In this case however, it is the men who need protecting. They are the oppressed "minority". Or do you just have no sympathy because they are generally white males?

The war is based on a LIE KATG, however, she on the otherhand may take a different position on the matter. That is not the point at hand, she should NOT lose custody of her child whether the war is based on a LIE or not, she did nothing wrong and she is losing custody of her child...Your insensitivity regarding the matter is just as bad as the idea that this woman is losing custody of her child, period...
