However, the paedophile appealed and the Supreme Court judges decided to commute his sentenced to just 5 years mainly based on these 2 aspects: 1- even though it was proved that the boy was forced to have sex with the adult out of fear, he could have said no, which he never did; 2- Every time the two were together (seven in total) the boy had an erection and ejaculated. The judges perorated that raping a 5 year old is very different from raping a 13 yo, meaning that the first, according to them, wouldnt be capable of having an erection and therefore pleasure.
