IS IT JUSTIFIED ARRESTING SOMEONE WHO BREAKS THE LAW?

[+] serious ballot by Kev24
ACTIVE Wed Aug 01, 07 - Sat Aug 04, 07

i got this ballot idea from seon's ballot. the couple in question were actually not arrested for flying the flag upside down -- they were arrested for assualting the police officer and resisting arrest. the couple in question were flying their flag upside down and had notes pinned to it. resident's complained and the police investigated. upon verifying that they were in fact desecrating the flag, a citation was going to be issued. that's it. but, once the couple assaulted the officer and he attempted to arrest them, they resisted -- hence how the resisting arrest charge would come into play.

what concerns me is a couple of things here.

one is how news stories can be altered or how wrong information is given and people go off thinking they know the truth when they really don't.

second is the law. there are quite a few people who think being arrested is some kind of violation of rights. it's not unless the arrest is unlawful. people forget that being arrested does not equate to guilt. police enforce the laws, they do not make them or determine the guilt or innocence. a judge and/or jury does. so people need to keep that in mind. everyone freaks out when they read stories like that, as if the police arresting this couple were some kind of nazi storm troopers. hardly. worry more what the courts do, not the police.

so the question is, do you think it is justified to arrest someone for breaking the law, or should the police randomly make exceptions and basically operate with no boundaries at all?

it is right to arrest someone who breaks the law
no, the police should be unpredictable and make decisions on the fly

good examples are protesters. when you see them getting arrested, it's usually not for protesting. it's usually cuz they threw something at the police, or they refused to step back off the street -- stuff like that. when you see it on the news, they leave all that out, cuz let's face it, showing the police and protesters clashing and people being arrested sells more papers and keeps more viewers than reporting the real reasons.

Kev, the answer to your first question, IMO, is the Fourth Estate, where they shape the way we view the world daily. So amny people accept what newscasters say, it's disturbing. Look at how amny people still eblieve that there are WMDs out there in iraq, just because Faux- eh, Fox News, pardon says that there are, with complete disregard for the fact that our own inspectors had free run of the place for over two years and found nothing.

To answer the second, I'll brand that simple stupididty. When I was a babe-in-arms, I learned that, if a man with a badge and a gun says do something, you do it. If you've done nothing wrong, due process will clear you. (Hopefully.)

^ i don't think anyone believes there are wmd's in iraq. a better example is the simplest one -- this story.

this is why everybody should have a video camera surveilance system in their home.

wouldn't it be good to see who was telling the truth?

They assulted a police officer? They could have just waited to take it to court, i'm sure the ACLU would have gotten involved. Why desecreate a flag, anyway? Who is going to read stupid notes pinned to it? And in doing so, it will further alienate you from neighbours. Whatever message you are trying to send, that is not the way to do it, people.

The charges don't usually stick and they'd have more than likely gotten off if they hadn't have assaulted the officer.

But because someone called in with a complaint, they have to send police officers there. There's an old man like that in my parents' neighborhood. He calls the police or the city hall complaining about the most nit-picky stuff around the neighborhood. The cops hate it when he calls, but they have to go check it out anyway.

yep. so some alarmists and opportunists will say they got arrested cuz they flew their flag upside down. not true at all. they got arrested cuz they assaulted the police officer, who was only responding to complaints made by other citizens.

exmple that applies -- man is jay walking across a busy city street. cop approaches him to give him a minor summons. man freaks out and punches the cop. cop finds cocaine on the man and an illegal handgun. man is arrested. opportunist press and gullible people say "man arrested for jay walking." nope.
by Kev24 on Wed Aug 01, 07 3:42pm [+]

^ Yep. And if the police officer makes the mistake of punching the coke addict back, it's "Jaywalker arrested after police brutality incident"

Spin it hard enough and people will be too dizzy to see the truth behind it.
