RHE man gets jail time
for property fixes

He built a fence, a retaining wall, a patio and a few concrete columns to decorate his driveway, and now Francisco Linares is going to jail for it.

Linares had been given six months to get final permits for the offending structures or remove them as part of a plea agreement reached in January, when he pleaded no contest to five misdemeanor counts of violating the Rolling Hills Estates building code.

If he failed to do one or the other, Linares faced six months in county jail.

On Monday, Torrance Superior Court Judge Sandra Thompson chastised Linares, a Farmers Insurance district manager, for not completing what he agreed to do in January and then handed him the maximum sentence without possibility of house arrest or probation.

"Imagine my disappointment to find we are no further along in resolving these issues," Thompson said. "At the rate we're going, we'll still be talking about this at my retirement party."

Linares is scheduled to report to county jail Sept. 10.

"I'm not scared," Linares said about spending time in jail. "It's just very unfair. The city said they wanted to teach me a lesson because they thought I wanted to get away with a lot of stuff."

Richard Hamar, Linares' attorney, said he has never heard of anything like this.
"We're talking about fixing a fence that was on city property," he said. "He didn't build a Las Vegas casino. You put a guy in jail for six months because he repaired the city fence?"


so paris hilton can get a dwi and then decides to drive on a suspended licsense and she gets 23 days in jail. nicole richie drives on drugs and she gets 82 minutes in jail. lindsay lohan gets in trouble every other week and in her latest, she takes 4 guys hostage in a car while on a drug-fueled rampage she chases another car. she gets arrested, has cocaine on her, but does not go to jail -- she goes to rehab. her sentence? 1 day in jail. 1 freaking day.

i think this all sounds fair to me. celbs are just so above the law!

*Waaaaaaaaaaaaaay* out of whack. As for what to do about it, I have no idea. I have several friends who are lawyers, and many of them crusade to have the statutes updated constantly. But they say that this, like all things, takes time.

That's f*cked up, but bear in mind the celebs on your list were probably FACING long sentences too, before the going through the court, but just didn't receive them. Odds are though you'll turn out to be right, we'll just have to wait and see.

Did he ask for any other offences to be taken into consideration? Lol, sorry couldn't resist.

^ that's just it though. the sentences handed down for the offenses of lohan, richie and hilton were what i said - 23 days, 82 minutes and 1 day respectively. the law stipulates that the maximum for each is in the years, not minutes or days and the minimum is at least a year. they got off.

Behind the scene deals, DAs and defense attorneys in cahoots together, grand jury members rigging arraignments on the suggestions of judges, etc... And that's just in the small town that I grew up in.

As mentioned in another ballot somewhere, my neighbor got caught with his 3rd DWI in as many months and never served over a day or so in jail. Where's our DA? Hell if I know. He's presided over an average of 1 case every two months. And that's with well over 200 cases plending.

A good friened of my sis in laws tried to file on his former renters for stolen property last year. The local sheriff refused to do anything, so the guy goes back to confront the renters. This time they assaulted him. He went back to the shefiff's office and once again tried to file charges (with knots on his head as proof) and was again turned down.

Just very small examples of a much larger problem...
