Not that I would take the allegations seriously but in most countries rape is defined as one party not consenting to the sex act. If she didn’t consent then she should have simply hung up the telephone. Then they have to get into the whole “what defines virginity” factor. She did not have intercourse with the man so she is technically still a virgin. I have never heard of the breaking of the hymen as defining a sex act or loss or virginity. Some young girls have broken their hymens from accidents such as rough horse rides or bicycle accidents, etc. That does not mean that she had sex with the horse/bike etc. There are some sex acts such as oral and anal that does not break the hymen. Therefore, if I forced someone into anal sex or forced them to perform oral sex would that not be considered rape? If I were a Judge I would throw it out of court on the first day or I might just let it go on just to hear what kind of crap they come up with.
