The US Supreme Court has struck down a law that would have allowed the execution of someone convicted of raping a child. The court said the Louisiana law would have violated the US constitution's ban on ‘cruel and unusual punishment’. “The death penalty is not a proportional punishment for the rape of a child,” wrote Justice Anthony Kennedy in his majority opinion. (BBC)

These people have mental problems. They have no control over their actions.

They should get mental health counseling and probation, JUST LIKE THE WOMEN SCHOOL TEACHERS WHO RAPE YOUNG BOYS!

Women always get a slap the wrist for the same crime as men.

Grapost, don't even bring that crap in the door. Most of these sick bastiches are beyond the help of mental-health facilities. Look up recitivism (sp?) rates. The compulsion to hurt children DOES NOT GO AWAY.

I agree with Truth; I think that in the vast majority of cases it is impossible to rehabilitate offenders of this most heinous crime. Personally, I do not believe that prison as a form of punishment works, though I can think of no suitable alternatives.

What Truth said. There's a big difference in a boy who willingly bones his teacher and a man who violently rapes young children. Yes, the legal labels are one size fits all, but that doesn't mean that all "sexual assaults" are the same.

The very large majority of those convicted on rape aren't mentally retarded and are perfectly able to tell right from wrong. They knew what they did was wrong when they did it, and they had a choice of not doing it. They just didn't care.
