Should you smoke or have sex?

Someone I know owes a fine and was given six months to repay, which he didn't, he was summoned back into court and the judge asked if he smoked, he replied yes, that was his mistake, the judge ripped into him, saying the money he paid for cigarettes could had paid the fine in full.

Cigarettes are not the best example because they are looked down upon in today's society, but it's a true story so I used , but lets say the judge asked if you had sex and how much did you spend on condoms or other birth control, is it okay for him to say, pay your fine first then have sex ?

What's more important to you, paying the government, courts, etc or satisfying your own personal and pleasurable but not necessary needs?

I don't like things hanging over my head. I would not enjoy my personal pleasures quite so much. But hey sex is almost free if you don't buy fancy stuff to go with it, like Kama Sutra lotions and candles, etc. If you have do-it-yourself sex, you don't even need to spend money on gas to drive over there.

Paying the government doesn't come first to me in all cases. But if I screw up, resulting in owing a fine, that's my problem and I need to do what it takes to pay it.

I've owed money before when I didn't have it, and the first thing I did was do away with the unnecessary junk I spent money on. After a while, that money adds up enough to really raise an eyebrow.

I think fines should be levied on a sliding scale.

way it is now, it gives the rich a carte blanche to commit any crimes (drunk driving, drugs, etc - just look at celebrity arrests) and the fine would be less than a price of a meal. same fine would devistate a single mother with 5 kids at home.

how about % of your net worth as fine? white collar crime would disappear as you know it.
