ATLANTA (Jan. 13) - A federal judge Thursday ordered a suburban Atlanta school system to remove stickers from its high school biology textbooks that call evolution ''a theory, not a fact,'' saying the disclaimers are an unconstitutional endorsement of religion.

''By denigrating evolution, the school board appears to be endorsing the well-known prevailing alternative theory, creationism or variations thereof, even though the sticker does not specifically reference any alternative theories,'' U.S. District Judge Clarence Cooper said.

The stickers were put inside the books' front covers by public school officials in Cobb County in 2002. They read: ''This textbook contains material on evolution. Evolution is a theory, not a fact, regarding the origin of living things. This material should be approached with an open mind, studied carefully and critically considered.''

''This is a great day for Cobb County students,'' said Michael Manely, an attorney for the parents who sued over the stickers. ''They're going to be permitted to learn science unadulterated by religious dogma.''

Doug Goodwin, a spokesman for Cobb County schools, had no immediate comment.

The stickers were added after more than 2,000 parents complained that the textbooks presented evolution as fact, without mentioning rival ideas about the beginnings of life, such as the biblical story of creation.

Six parents and the American Civil Liberties Union then sued, contending the disclaimers violated the separation of church and state and unfairly singled out evolution from thousands of other scientific theories as suspect.

At a trial in federal court in November, the school system defended the stickers as a show of tolerance, not religious activism.

''Science and religion are related and they're not mutually exclusive,'' school district attorney Linwood Gunn said. ''This sticker was an effort to get past that conflict and to teach good science.''

But the judge disagreed: ''While evolution is subject to criticism, particularly with respect to the mechanism by which it occurred, the sticker misleads students regarding the significance and value of evolution in the scientific community.''

The case is one of several battles waged around the country in recent years over what role evolution should play in the teaching of science.

Last year, Georgia's education chief proposed a science curriculum that dropped the word ''evolution'' in favor of ''changes over time.'' The idea was dropped amid protests from teachers.

A school district in Dover, Pa., has been locked in a dispute over a requirement that science students be told about ''intelligent design'' - the concept that the universe is so complex it must have been created by some higher power.

It seems fair.
There seems to be no religious basis in the stickers; thus no problem.

Now I usually agree with the ACLU on their choices, but this time I think they're in the wrong. The stickers don't seem to imply anything about religion, and evolution is indeed a theory. It IS one of many theories, but it's also by far the most commonly-accepted one. Schools need to teach theories as such and not as fact, and evolution is no different. The stickers don't bother me at all.

People saying "Theory of Evolution" is much like when I say "Goddamit" when I hit my thumb with a hammer- Purely out of habit, I don't believe in god. While it was once a theory, it has proven beyond the reasonable doubt that it is a fact. Heck even the "Theory of Relativity" has been proven to be a scientific fact, and that theory is 200 years younger. It's been a while since the church took the leap and accepted a scientific fact (I think the last major one was something about earth not being the center of the universe...) I wonder when they will finally catch up?

Has it really been proven that factual LCD? Maybe I'm a little behind on this -- I've never been good at science.

As for the Catholic church accepting a scientific fact -- I think the last one was in the mid-80s when the pope finally confessed that Earth was, indeed, round. Why the hell do I belong to this group of idiots?

Both the second and third choices seem appropriate. I have no problem with the stickers. I would have a problem with 'intelligent design' being taught in science classes as there are absolutely no facts supporting theories of creation, whereas Evolution is based upon facts. If people want to study different theories about creation, they should do so in an elected college class. Dropping the word 'Evolution' from the theory originally called 'The Theory of Evolution' is just ridiculous and completely beside the point.

Thank you, Cobb County, for showing the world how far behind the times Georgia is. Something that is, at worst, a no-brainer, gets up-twisted into a tornado. Anyone with more than six brain cells can figure out that evolution IS a theory, and that it's not worth the time and effort of raising a legal challenge. And the citizens here wonder why Georgia is dead last in the nation in SAT scores...

I don't think the stickers were necessary in the first place. Children should be taught what a theory is. Children should be taught in great detail what evolution is, but I do believe there's enough room in the textbook to devote a paragraph or two to alternative theories.

That being said, there is absolutely no need for a sticker in the first place place. Good call on the removal.

Well evolution IS a theory. It has a plenty of evidence, is universally accepted by educated people as the way things happened, and is most likely true. But by the technical definition of the word it is still a theory.

I don't mind them pointing this out so long as they teach it fairly afterwards and don't try to mix in creationism.

I think that any student who pays the slightest attention in science class will know that evolution is a theory, and not a fact. It is also up to the teacher to teach that, not a sticker on their textbook.
