Let's take an example of an 18 year old guy who has sex with a 17 year old girl. By the letter of the law, he is an adult and she is a minor, so this is statutory rape. Let's say he didn't know she was 17, since she told him she was 18 and he had no reason to not believe her. Under such a situation, the guy could be sent to prison for quite a while. So, do you think this induvidual should be sent to prison? If not, what punishment, if any, should he receive?

The law is the law. If the guy KNEW her age then all they had to do is wait one more year at most. If she lies to him, the punishment should be very minor, depends on the case and the court's decision.

That is one flaw of this law. But if we lowered the age, the same can be said for that age too. In Canada what if one person is 14 and one is 13 and they choose to have sex? It's still the same issue.

Besides, lowering the age of consent only makes it more dangerous. It STILL lets a 40-something yr old have sex with a teenager if they want to. I don't believe that should go on. People can wait, that's all u have to do.
You have to wait with driving, with drinking beer, and yes sex with adults. If they're 17, whats the problem waiting till your birthday? The whole law doesn't need to be change for that ONE case.

I did it. Of course where I come from there is a little leeway people that are 17 are said to have ‘carnal knowledge’ and thus are exempt for statutory rape laws.

Cletus, did you pull this from the stories that just occurred here in Georgia, about the football players, one high-school and one college, who both did the same thing? The high-school kid went to prison for forty years, with the jury taking the extraordinary measure of making a joint statement to the press to the effect that they didn't want to convict him, but the letter of the law left them with no other option. The college kid got probation, and everyone in his hometown, including the "victim", turned out to welcome him home. The entire legal system is "changing and growing", according to a lawyer friend of mine, so things such as this are expected. Scary, eh?

The law should state punishment only if one person is a minor, the other is adult and the age difference is greater than x amount of years (where x=2???).

I'm not sure about other states, but in Iowa there's like a three-year 'grace period' of sorts in that situation (i.e. if you're 18, you can legally fuck a 15-year-old). In Iowa, 16 is legal as well.

here in Australia .. the department of community development ( who would deal with it) would not bother with prosecution as the age of the person being the victim would probably be legal by the time it got to court.

I'm thinking that even if he did know and even if her parents brought charges against him he would get at the worst a slap on the wrist--unless the girl is mentally disabled--most statutory rapes that are procecuted are for more extreme cases like a 22 year old man and a 16 yr old girl--the court considers the amount of age difference.

In a lot of states, Iowa included, there's a grace period of sorts, saying that if you're within X-amount of years of the partner's age it isn't statutory rape.

In Iowa, 16 is the legal age of full consent, but I think there's like a three-year grace period under that, i.e. a 16-year-old can fuck a 13-year-old legally.
