SIDNEY — A man found guilty of sexually assaulting a child has been given 10 years of probation by a judge who said the man was too small to survive prison.

District Judge Kristine Cecava of Cheyenne County sentenced Richard W. Thompson, 50, Tuesday on two counts of sexually assaulting a minor.

“What you have done is absolutely inexcusable,” she said.

His crimes deserved a long sentence, Cecava said, but she expressed concern that the 5-foot-1 Thompson would be especially imperiled by prison dangers.

“Can I make other children safe from you?” the judge said. “You are a sex offender, and you did it to a child.”

But, she said, “That doesn’t make you a hunter. You do not fit in that category.

“I’m going to try to put together some kind of order to keep you out of prison.”

He will be electronically monitored the first four months of his probation, and he was told to never be alone with someone under age 18 or date or live with a woman whose children were under 18. Cecava also ordered Thompson to get rid of his pornography.

I have to say, I don't have a lot of sympathy for the guy.

But I'm curious if it works the other way, are judges more willing to sentence large, physically strong men to jail?

I think most of us can agree that pederasts deserve little mercy. If there were any justice, his balls would be cut off using gardening tools.

However, this case does serve to illustrate the fact that prison has become synonymous with rape. Maybe there are some people who deserve to be held down by four inmates and sodomized, such as violent pedophiles. But most of the rest of the general population, particularly those convicted of non-violent offenses, deserve a reasonable measure of security against the threat of rape and potential transmission of HIV and other viruses.

I'm not sure how you do that. Obviously, when you put so many criminals into a confined space, something bad is bound to happen. Increased security would help to mediate that problem. The question is: How much money is it worth to employ more guards to protect inmates?

It's a deep primal instinct to protect our children, ape. A deep, gut wrenching fear that someone could harm my babies, kept only at bay by the intensity of desire to protect them from scum like that.

You hear a story like this and you can't help putting yourself in the shoes of the parents of the child .
You can be sure that I'd move heaven and Earth to ensure my kids will not be harmed, legally or illegally.

If I was 100% sure that the perv was guilty, I'd stand by my earlier comment and my 'Justice'.

Lol, plus I was brought up in a rough part of Liverpool (search Wikipedia - Toxteth Riots), where the police often feared to tread.

'justice' was often metered out by the community itself, for most crimes involving scumbags, mugging old ladies, house burlary etc. It was the only way 'Justice' would ever be served.

I have to agree with lil_ape ... I'm amazed that certain crimes cause us to throw out all semblence of Rule of Law and descend into savagery.

As for the judge';s decision -- more of an indictment on the Prison System.

What amazes me is that you seem to be saying that a death sentence isn't savage and is perfectly ok as long as it's done 'properly' by your Government. (In one of the most savage ways possible, the electric chair)

IC: I was unclear then -- I am against the death penalty. My reference was in regards to a prison sentence that, in effect (e.g., due to the convict's age) could be effectively be construed as a death penalty.
