In the Supreme Court's decision on the Hamdan v Rumsfeld case, they wrote a key footnote on page 29:

Whether or not the President has independent power, absent congressional authorization, to convene military commissions, he may not disregard limitations that Congress has, in proper exercise of its own war powers, placed on his powers.

Does the Hamdan decision deliver a fatal blow to the Addington/Yoo theory of Unitary Executive power, championed by George W Bush and Dick Cheney?

That Unitary Executive and War-Time President set of legal theories served as the basis for not only Rumsfeld's military tribunals at Guantanamo, but also for the NSA program and the extreme interrogation methods endorsed by the Bush Administration.

IMO, he is undone ... all of these actions have now been shown to be categorically illegal.

But I wouldn't count on it being fatal. A great many of us said that the lot of them wouldn't be returned to office in '04.

As for otthwer controversial actions he has or may yet undertake, I say the same. In the future, he might go so far as to seek the "approval" of the masses through the media.

I think this is but a temporary bump in the road for Bush's plan to create a "dictatorial presidency."

Bush has the soul of a criminal: no respect for the Constitution, none for any law that might impede him in the fulfillment of his perverse desires, and none for any person who isn't loyal and obedient to him.

He and his gang will pause, then plot and plan ways around this decision, much to the detriment of the nation.

No Cathexis you are wrong that the Unit.Executive has been undone by this decision because all Bush needs is for Congress to pass a bill giving him the authority to try detainees in Gitmo.Infact Republican Congressmen are already working on this bill.

Well probably, but it won't stop most of the actions being taken in regards to terrorism. Congress will likely grant these to him officially - which should have been done before (if you agree he should have them).
