Very tough call ... I keep waivering on whether US or Iraq should have jurisdiction on this.
Perhaps an error of words or perhaps prejudical bias, I believe the former, but either way, the fair and proper ballot question should include the word "ALLEGED".

No there is no way in hell he could get a fair and impartial jury in Iraq.Anyway the soldier that allegelly raped and murdered that 14 year old girl is now a civilian and he must be tried by a civilian court.If he was still enlisted he could be tried by the military court system.
Corrupt: Even if the alleged crime took place while he was in the military? I'd think a military court would still be approrpriate.
Iraqi constitution explicitly exempts american soldiers from being tried in Iraq. Doesn't seem very fair does it? and Bush calls that Iraqis governing their own people and country? We should let them be tried in iraq, and be sentenced there. That's the only way to keep our rhetoric worth the paper it's written on, and prevent more of our soldiers from being targetted for revenge attacks.

Cathexis the Constitution prohibits civilians from being tried by military courts,tribunals etc.The circumstances may lead you to believe that because the event happened when he was a soldier he should be tried in a m.c.However the fact still remains that his status has changed from G.I to civilian and therefore the government must try him in civilian court.Not to do so would violate his 6th Amendmant right to a jury of his peers.
He committed the crime in Iraq, he should be tried in Iraq. Like it works under the laws of any other sovereign nation; but Iraq is not a sovereign nation is it? It's an occupied country and the oppressors always make the laws to protect their agents from legal prosecution by the oppressed.
