NEW LAW FOR NATIONAL SEX OFFENDER REGISTRY GOOD IDEA OR NOT?

[+] serious ballot by jappy
ACTIVE Thu Jul 27, 06 - Tue Apr 21, 09

This new law will establish a national sex offender registry and try to make it harder for sexual predators to reach children on the Internet.

While this law has good intentions, it does not take into account the different ways that each individual state determines who is or is not a child molester, therefore the law can easily subject someone who is not even remotely a pedophile to federal standards that aren't taking into account the differences in each state's determination of what is or isn't a pedophile.

Case in point. An 18 year old who is convicted of having sex with a 15 year old girl can be added to the sex registry list in Nebraska, and in fact in most cases is.

Let's think about this for a moment. A senior in high school dating a sophomore in high school can be convicted and possibly thrown in jail for that relationship, which, sorry to say, is a normal relationship by any REASONABLE standard.

Not only that, but they are then indefinitely put on a sex registry list in Nebraska from which it is nearly impossible to get yourself removed from. Also, the test given to determine who is or is not a sex offender in Nebraska has been routinely failed by some 1/3 of random people off the street who have taken it. The test is a multiple choice test that asks you all sorts of weird questions, many of which do not even remotely seem associated with sexuality, but some psychologist somewhere determined that answering a specific way makes you a pedophile or more apt to commit acts of lewdness against children.

THis is just ONE state. Until there are better mandated federal guidelines to determine who is or is not a pedophile, shouldn't the federal government hold off making this sort of list of offenders?

Yes, this is a good idea and I have no problem with it at all.
Yes, this is a good idea but there are problems with it that should be addressed.
No, this is a bad idea overall.

COMMENTS:
This is a state issue and not a Federal one. As each state has its own age of consent rules, the Federal government is actually over-stepping its boundaries. If a state says that 16 is the age of consent, but another state says the age is 18, how can the Federal government be permitted to pass any laws regarding this issue? Constitutionally, its very questionable and infringes on States rights.

The benefits of this law so vastly out weigh the possible problems. I understand your point but find it minimal as compared to the thousands of 'children' that will be covered.

^ the 'age of consent' issue is, I agree, problematic but let us not let this overshadow the true meaning of this law....protecting our 'children' from these bastards. Everything in life is a trade off. This possinle problem with the law is insignificant when compared to all the good that will come out of it. 'Age of consent' cases are heard by each state quite often and are solved on a case to case basis. there are always exceptions to the rules. Again, "Let us look at the true purpose of this law....protecting our innocent children from monsters."

If you did the crime, tough turkey.
by Truthseeker013 on Sat Jul 29, 06 4:35pm [+]

But would you consider it a crime if a senior in high school has sex with a sophomore in high school?
by jappy on Sun Jul 30, 06 9:55am [+]

^How many of those cases have you seen prosecuted?
by xhiker on Tue Aug 01, 06 11:47am [+]

more than you would think, it's utterly ridiculous. It usually comes from Mommy and Daddy find out little girl has been having sex so they go after the guy.
